This Privacy Policy explains how Trak Advantage Corp (“TAC,” “we,” “us,” or “our”) collects, uses, shares, and protects information when you use our websites, applications, and services (collectively, the “Services”).

1. Scope and Relationship

This Privacy Policy applies only to information collected through the Services.

Your use of the Services is also governed by our Terms of Service and Refund Policy, which include (among other provisions) mandatory individual arbitration, a class action waiver, limitation of liability, and Florida governing law. If there is a conflict, the Terms of Service controls for disputes and enforcement.

Nothing in this Privacy Policy creates any fiduciary duty, partnership, employment, agency, or joint venture relationship between you and TAC.

Email verification is required. Anonymous accounts are not permitted.

Children under 13 may not create accounts independently. If you are under 13, a parent or legal guardian must create and manage your account.

If a parent/guardian creates or manages an account for a minor, the parent/guardian:

  • Assumes full responsibility for all account activity
  • Accepts financial responsibility for all charges
  • Consents to monitoring, content analysis, and data processing described in this policy
  • Agrees to supervise the minor’s use of the Services

We may suspend or terminate accounts if we suspect age misrepresentation or inability to verify parental involvement.

B. Payment and Billing Information

Payments are processed through PCI-DSS compliant third-party payment processors. TAC does not store full credit card  or bank account numbers.

We may receive limited billing details from processors (e.g., billing ZIP/postal code, last four digits, payment status, subscription state, chargeback/dispute signals).

Chargebacks, payment disputes, subscription failures, and suspected fraud may result in immediate suspension or termination and may limit or eliminate eligibility for refunds (see Refund Policy).

C. Usage and Technical Information (Automatically Collected)

When you use the Services, we may automatically collect:

  • IP address and approximate location (derived from IP)
  • Device identifiers
  • Browser type and settings
  • Operating system
  • Log files and timestamps
  • Crash/error diagnostics
  • Session activity and feature usage metrics
  • Referring/exit pages, clicks, and interaction patterns

We use this data to:

  • Secure the platform, prevent fraud, detect abuse

  • Enforce our Terms and policies
  • Comply with legal obligations and protect TAC and users

D. Cookies, Pixels, Local Storage, and Similar Technologies

  • Prevent fraud and abuse

You can limit cookies through your browser/device settings, but some features may not work.

We do not respond to “Do Not Track” signals where the law permits.

E. User Content

5. AI Content Analysis and Monitoring (Consent)

To protect the Services and users, we may analyze activity and User Content using:

  • Human review as needed

Monitoring may occur:

  • at upload/submission
  • during storage
  • during editing/modification
  • during account activity
  • during enforcement review

  • AI systems may produce false positives/false negatives
  • We do not guarantee detection of all prohibited content
  • We retain sole discretion in determining policy violations
  • Monitoring outputs and related logs may be retained for investigations and legal compliance

6. Removal, Enforcement, and Law Enforcement Cooperation

If we reasonably believe content or conduct violates law or our policies, we may, at our sole discretion:

  • Remove or restrict content
  • Suspend or terminate accounts
  • Preserve evidence and logs
  • Report to law enforcement or regulators where permitted/required
  • Share relevant information with authorities, advisors, and service providers as legally allowed

We may act without prior notice where legally permitted.


7. Account Security and Verification

We may require security measures such as:

  • Multi-factor authentication (MFA)
  • SMS/email verification
  • Identity verification or additional authentication steps (including to investigate fraud, disputes, refunds, or abuse)

You are responsible for safeguarding your credentials and device access. TAC is not responsible for unauthorized access caused by your actions or negligence.


8. When We Share Information (No Sale of Personal Information)

We do not sell personal information.

We may share information as necessary to run and protect the Services, including:

  1. Service Providers (hosting, analytics, support tools, fraud prevention, communications tools)
  2. Payment Processors to process transactions and manage disputes/chargebacks
  3. Legal and Safety: to comply with law, respond to lawful requests, or protect rights, safety, and security
  4. Enforcement: to enforce our Terms and policies
  5. Business Transfers: if we are involved in a merger, acquisition, financing, restructuring, or sale of assets

Service Providers are expected to safeguard data under contract, but TAC is not liable for the independent acts or omissions of third parties beyond our reasonable control.


9. Data Retention

We retain information as long as reasonably necessary for legitimate business purposes and legal obligations, including enforcement and dispute resolution.

Typical examples (may vary based on risk, legal holds, and investigations):

  • Account data: while your account is active, plus up to 1 year
  • Logs/IP/technical data: up to 6 months (or longer for security/legal needs)
  • Payment and tax records: up to 7 years
  • Deleted User Content: up to 30 days, or longer if needed for investigations, enforcement, backups, or legal compliance

We may retain aggregated, de-identified, or anonymized data indefinitely.

We may deny deletion or access requests where legally permitted (including where compliance would be impractical, abusive, or would compromise security, fraud prevention, or legal obligations).


10. Children’s Privacy (Under 13)

We do not knowingly collect personal information from children under 13 without verifiable parental involvement.

We may request proof of parental authority/consent. We may suspend or terminate accounts if parental involvement cannot be verified.


11. Data Security (No Guarantees)

We use commercially reasonable administrative, technical, and physical safeguards. However:

  • No system is 100% secure
  • You use the Services and transmit information at your own risk
  • We do not guarantee absolute security

Where legally required, we will provide breach notices to affected users.


12. Your Rights and Requests

The Services are operated from the United States. By using the Services, you understand and consent that your information may be processed and stored in the U.S. and other countries where our service providers operate.

Where required, we may rely on appropriate transfer mechanisms (such as standard contractual clauses).


14. No Educational, Athletic, or Accuracy Guarantees

The Services are designed to assist learning, organization, and analytics. We do not guarantee:

  • academic outcomes or grade improvement
  • learning results
  • athletic performance improvement
  • statistical accuracy
  • completeness or reliability of any AI outputs

You are responsible for independently verifying information before relying on it.


15. “AS IS” Services; Limitation of Liability

To the maximum extent permitted by law:

  • The Services are provided “AS IS” and “AS AVAILABLE”
  • We disclaim all warranties, express or implied

TAC is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including:

  • lost profits
  • lost revenue
  • loss of data
  • business interruption
  • loss of goodwill

Total liability is limited to the lesser of:

  • $100 USD, or
  • the amount you paid TAC in the past 12 months

16. Governing Law and Dispute Resolution

This Privacy Policy (and privacy-related disputes) are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

All disputes must be resolved by binding individual arbitration as described in the Terms of Service. You waive:

  • jury trial
  • class actions
  • consolidated proceedings

17. Changes to This Privacy Policy

We may update this Privacy Policy at any time. Changes are effective when posted. Continued use of the Services after changes means you accept the revised policy.
